Equine Adoption Contract
This agreement is made on the ____ day of _________ by and
between_________________, hereafter referred to as “Adopter”
and East Texas Horse Rescue and Sanctuary, hereafter referred as
ETHRS.
ETHRS owns equine number ______, named ____________. The
equine is registered with _____________ number______. The
Adopter wishes to adopt the above described equine and agree to
the following:
1. The Adopter agrees to pay ETHRS the adoption fee of $______.
2. ETHRS will retain ownership of the above described equine
for a period of one (1) year.
3. During the above noted year, the Adopter will be financially
responsible for all expenses incurred by the above described
equine. This includes but is not limited to: Adequate food,
water, shelter, worming, hoof care, and veterinary care.
4. The Adopter agrees to allow a representative of ETHRS
access to the equine and its home for purposes of site visits
providing the representative has a letter signed by at least one
officer of ETHRS in his/her possession that states why any
unannounced visit is being conducted.
5. During the above noted year, ETHRS will make site visits to
check on the health, care, environment and the well being of
the above described equine per the ETHRS Inspection Police.
Further site visits may be scheduled if ETHRS deems them
necessary. If any of these inspections are denied the contract
will be terminated and the equine will be returned to ETHRS.
6. The Adopter agrees to release the above described equine to
any representative of ETHRS if that representative has found
that the equine is not being adequately cared for or the terms
of the adoption contract is not being met.
7. The Adopter agrees to have a qualified veterinarian provide a
health certificate and ETHRS Equine Veterinary Approval
Form to ETHRS approximately one year after adoption of the
above described equine (Coggins Certificate).
8. The Adopter agrees never to sell, give away, or lease and
never to send the Equine to slaughter. If the Adopter can no
longer care for the equine or not longer wishes to keep the
equine the Adopter must return the equine to ETHRS. If the
Adopter violates this, The Adopter may and can be held
liable for the value of the equine and any cost incurred by
ETHRS when attempting to recover the equine.
9. The value of all ETHRS horses is $5000.00.
10. The Adopter agrees NOT TO BREED the above
equine.
11. ETHRS is not responsible for any veterinary care or any
other expenses incurred by the equine after the adoption is
signed.
12. The Adopter agrees that should the adopted equine die,
a written statement of death by a licensed veterinarian will be
given to ETHRS.
13. The Adopter agrees to provide written notice of any
change of location of the above described equine before the
equine is moved until the contract is fulfilled. This includes
but is not limited to trainers.
14. ETHRS will not be held responsible for any
damages or injuries caused by the above described equine.
15. If the Adopter dies or becomes mentally unable to care
for his/her own self before or after the one year period has
passed, his/her family will be allowed to keep the equine
provided the family meets ETHRS adoption requirements.
16. The Adopter agrees to complete and mail back the
ETHRS adoption paperwork within ten (10) days of receiving
the contract.
17. Failure to complete and return the final contract
paperwork within thirty (30) days will constitute Breech of
Contract and the equine will be picked up.
18. Failure to complete the final paperwork will constitute Breech
of Contract and the equine will be picked up.
19. ETHRS agrees to turn ownership (including registration
papers if they are in possession of ETHRS) to the Adopter
one year after the date of this contract providing all
conditions of this contract has been met.
20. This contract can be amended or alter only upon written
agreement of the Adopter and ETHRS.
21. The Adopter assumes all liabilities associated with the
equine.
22. The Adopter has read, understands, and will heed the
following warning:
WARNING:
UNDER TEXAS LAW (CHAPTER 87, CIVIL PRACTICE AND
REMEDIES CODE), AN EQUINE PROFESSIONAL IS NOT LIABLE
FOR AN INJURY TO OR THE DEATH OF A PARTICIPANT IN EQUINE
ACTIVITIES RESULTING FROM THE INHERENT RISKS OF EQUINE
ACTIVITIES.
23. This contract and all of its provision shall bind the
heirs,executors, administrators, personal representatives, and
assigns of the parties hereto.
24. If any portion of this contract is held to be invalid or
unenforceable, all other portions shall continue to be
in full force.
The contract is in force as of the undersigned date and is in full
agreement by the Adopter and ETHRS.
